Who is the mediator? How to be?

The mediator is a law school graduate who has at least 5 years of experience in the profession; is a person who has been trained in mediation, communication and interview techniques (Mediation Act Art. 20). Lawyers can also be mediators; for this reason, the term ”mediator lawyer“ is used among the people.

After graduating from law school, mediators receive vocational training including theoretical and practical knowledge such as basic information about mediation, communication techniques, negotiation and conflict resolution methods, behavioral psychology. After the vocational training, professional competence is measured with the mediation exam. Mediators who have successfully passed the mediation exam must register to the mediation list in order to operate.

Specifically only those registered to the list of mediation held by the Ministry of Justice may conduct mediation activities.

In which countries is mediation implemented?

Mediation is mainly in the USA and the United Kingdom, Germany, France, Italy, Austria, Holland, Denmark, Poland, Hungary, Portugal, Romania, Czech Republic, Slovakia, Lithuania and other European Union countries such as Australia, Singapore, Hong Kong and South Korea. It is frequently applied in eastern countries.
